These Terms and Conditions (“Terms”) govern your access to and use of the Archiia platform (“Platform”). By accessing or using the Platform, you agree to be bound by these Terms.
1.1 You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use the Platform.
1.2 You are solely responsible for your use of the Platform and for all content that you submit, post, or transmit through the Platform.
1.3 You agree not to use the Platform for any unlawful purpose or in any manner that violates these Terms.
1.4 You will not infringe on the intellectual property rights of others, or transmit any content that is defamatory, threatening, obscene, harassing, or invasive of privacy.
1.5 You will not impersonate any person or entity, or misrepresent your affiliation with a person or entity.
1.6 You will not interfere with or disrupt the Platform or servers or networks connected to the Platform.
2.1 You may create an account on the Platform (“Account”). You are responsible for maintaining the confidentiality of your account information, including your password. You are also responsible for all activities that occur under your account.
2.2 You agree to notify us immediately of any unauthorized use of your account or any other breach of security.
3.1 You retain all ownership rights to the content you submit, post, or transmit through the Platform (“Content”).
3.2 By submitting Content to the Platform, you grant Archiia a non-exclusive, royalty-free, worldwide license to use, reproduce, modify, publish, and distribute your Content on the Platform.
3.3 You represent and warrant that you have all necessary rights and licenses to submit the Content to the Platform and to grant us the aforementioned license.
4.1 Archiia offers various subscription plans that provide access to different features and benefits on the Platform. You can find a detailed description of the subscription plans and their pricing on our website.
4.2 You can subscribe to a plan by following the instructions on the Platform. You will be prompted to provide your payment information, such as your credit card number or other relevant details.
4.3 Your subscription will automatically renew at the end of the subscription term unless you cancel it before the renewal date. You can cancel your subscription at any time through your account settings.
5.1 You agree to pay all fees associated with your subscription in accordance with the chosen plan.
5.2 We accept payment by UPI, credit card, debit card, PayPal.
5.3 Payment will be charged to your chosen payment method at the beginning of each billing period.
5.4 If your payment is declined, we may suspend your access to the Platform until the payment is successfully processed.
5.5 We reserve the right to change our subscription fees at any time. We will provide notice of any changes before they take effect.
5.6 You are responsible for any taxes or other charges associated with your subscription.
6.1 We offer a full refund for subscriptions canceled within 28 days of the initial purchase. After 28 days, no refunds will be issued.
6.2 To request a refund, please contact us at queries@archiia.com within the specified timeframe. Please include your name, email address, and the reason for your cancellation request.
6.3 Refunds will be processed within 14 business days of receiving your request. The refund will be issued to the original payment method used for the purchase.
7.1 The Platform and all Content provided on the Platform are provided “as is” and without warranties of any kind, express or implied. Archiia disclaims all warranties, including, but not limited to, warranties of merchantability, fitness for a particular purpose, and non-infringement.
7.2 Archiia does not warrant that the Platform will be uninterrupted or error-free, that defects will be corrected, or that the Platform is free of viruses or other harmful components.
7.3 You use the Platform at your own risk. Archiia will not be liable for any damages arising out of your use of the Platform.
8.1 To the maximum extent permitted by law, Archiia shall not be liable for any direct, indirect, incidental, consequential, special, punitive, or exemplary damages arising out of or related to your use of the Platform, even if Archiia has been advised of the possibility of such damages.
9.1 You agree to indemnify and hold harmless Archiia, its officers, directors, employees, agents, and licensors from and against any and all claims, losses, damages, liabilities, costs, and expenses (including attorney’s fees) arising out of or related to your use of the Platform or your violation of these Terms.
10.1 We may terminate your access to the Platform at any time, for any reason, with or without notice.
10.2 You may terminate your Account at any time.
11.1 These Terms shall be governed by and construed in accordance with the laws of the State of Maharashtra, without regard to its conflict of laws provisions.
12.1 Any dispute arising out of or relating to these Terms shall be resolved by binding arbitration in accordance with the rules of the American Arbitration Association (“AAA”). The arbitration shall be held in Pune, Maharashtra. The decision of the arbitrator shall be final and binding on the parties.
13.1 These Terms constitute the entire agreement between you and Archiia regarding your use of the Platform.
14.1 If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall remain in full force and effect.
15.1 No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision.
